Outreau / Mourmand: not necessary

The Court of Appeal of Douai (North) confirmed today the decision to not proceed in the investigation into the death in custody of Mourmand Francis, who had been suspected in the case Outreau pedophilia, officials said a judicial source. An initial decision of dismissal was imposed in July by a judge in Lille in charge of criminal investigation for manslaughter opened against X in the case of death in prison.


Mourmand Lydia, sister of the deceased who has always protested his innocence, had appealed this decision. It may still decide to lodge an appeal. Mourmand Francis died at age 32 in June 2002 of a drug overdose while in custody at the remand of Douai after his indictment in the case of Outreau.


At trial, the judge handling the case had found that his death was drug intoxication, whose causes could not be established with certainty. In its order, the magistrate had particular that Mourmand Francis did not take his salary in accordance the requirements, referring to a "potentially lethal effect of the drug mixture, but unpredictable."


the 17 other defendants in the case Outreau decade ago after allegations spread by children, thirteen were acquitted at trial in 2004 in Boulogne- on-Sea or on appeal in 2005 in Paris.
